01. ACCEPTANCE OF TERMS

By accessing or using the Deathborn07 Platform ("Platform") — including the website, presale portal, smart contracts, and any future metaverse application — you agree to be bound by these Terms & Conditions ("Terms").

If you do not agree to these Terms, you must immediately cease using the Platform. These Terms constitute a legally binding agreement between you ("User") and Deathborn07 Protocol ("Company").

02. ELIGIBILITY

By using the Platform, you represent and warrant that:

• You are at least 18 years of age
• You are legally permitted to participate in token purchases in your jurisdiction
• You are not a citizen or resident of any country where token sales are prohibited
• You are not on any government sanctions list (OFAC, UN, EU, etc.)
• You understand the risks associated with cryptocurrency investments
• You are accessing the Platform for personal use, not on behalf of an ineligible party

03. DB07 TOKEN — NATURE & RISKS

DB07 is a utility token designed exclusively for use within the Deathborn07 ecosystem. It is not intended to be a security, investment product, or financial instrument.

You acknowledge and accept the following risks:

• Cryptocurrency values are highly volatile and may decrease to zero
• Regulatory actions may restrict or prohibit token use in your jurisdiction
• Smart contracts may contain undiscovered vulnerabilities
• The metaverse product is under development and may be delayed or materially altered
• Liquidity on secondary markets is not guaranteed
• Blockchain transactions are irreversible

Participating in the presale does not guarantee any financial return. Do not invest more than you can afford to lose.

04. PRESALE TERMS

The Deathborn07 presale is subject to the following conditions:

• Presale tokens are subject to a 6-month cliff and 12-month linear vesting schedule
• All purchases are final — no refunds are permitted after transaction confirmation
• The Company reserves the right to modify presale stages, pricing, and allocation limits
• Users are responsible for providing correct wallet addresses — lost tokens due to incorrect addresses cannot be recovered
• The Company reserves the right to reject or cancel any presale order at its sole discretion
• Token distribution will occur according to the vesting schedule published in the Whitepaper

05. WALLET & SECURITY

You are solely responsible for the security of your cryptocurrency wallet, private keys, and seed phrases. Deathborn07 will never ask for your private key.

• Do not share your private key or seed phrase with anyone
• Use hardware wallets for large holdings where possible
• Verify all contract addresses on the official Deathborn07 website before sending funds
• Beware of phishing sites, fake Telegram channels, and impersonators
• The Company is not responsible for losses due to user security failures

06. PROHIBITED ACTIVITIES

You agree not to engage in any of the following:

• Using the Platform for money laundering or terrorist financing
• Attempting to hack, reverse-engineer, or exploit Platform systems or smart contracts
• Creating fake accounts or manipulating presale metrics
• Violating any applicable local, national, or international law
• Posting false, misleading, or defamatory content about the project
• Market manipulation including wash trading or pump-and-dump schemes
• Impersonating Deathborn07 team members or official accounts

07. INTELLECTUAL PROPERTY

All content on the Platform — including but not limited to logos, artwork, game assets, written content, code, and the Deathborn07 brand identity — is the exclusive intellectual property of the Deathborn07 Protocol.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes only. Unauthorized reproduction, distribution, or modification of Platform content is strictly prohibited.

08. NFT OWNERSHIP TERMS

When you purchase a Deathborn07 NFT (including Founding Fighter NFTs), you own the underlying token on the blockchain. However:

• You do not acquire any copyright or IP rights to the artwork
• NFT utility is contingent on the Deathborn07 metaverse remaining operational
• The Company reserves the right to modify in-game NFT attributes via smart contract upgrades
• NFT resale is permitted on approved secondary marketplaces

09. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEATHBORN07 DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEATHBORN07, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Loss of cryptocurrency or digital assets
• Loss of profit, revenue, or business opportunity
• Indirect, incidental, or consequential damages
• Losses resulting from smart contract exploits or third-party hacks
• Market volatility losses

Our aggregate liability to you shall not exceed the amount you paid for DB07 tokens in the most recent presale transaction.

11. GOVERNING LAW & DISPUTES

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction where Deathborn07 is incorporated. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation.

If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration. Class action lawsuits are expressly waived.

12. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform after modifications constitutes acceptance of the revised Terms.

Material changes will be communicated via email to registered users and announced in official Deathborn07 channels.
